1) Acceptance of Terms

By accessing or using www.moirasilverthreads.com (the “Site”), purchasing products, or requesting services, you agree to these Terms & Conditions (“Terms”) and our linked policies: Privacy Policy, Shipping Policy, Returns Policy, and Cookie Policy. If you do not agree, please do not use the Site.

2) Eligibility

You must be 18+ (or have legal guardian authorization) to purchase or create an account. The Site is not directed to children under 13.

3) Account & Security

You are responsible for keeping your credentials confidential and for activity under your account. Notify us promptly of any unauthorized use.

4) Orders & Acceptance

All orders are subject to acceptance by MOIRA. We may refuse or cancel an order due to availability, pricing/info errors, suspected fraud, or breach of these Terms. If we cancel after charging you, we will issue a refund of amounts paid.

5) Pricing, Taxes & Availability

Prices are in USD and include/exclude applicable taxes based on your address at checkout. We may change prices and correct errors at any time. Availability may change without notice.

6) Payments

Payments are processed via Wix Payments and/or PayPal. We do not store full card numbers. By placing an order you authorize the total charge (including taxes and shipping).

7) Shipping & Delivery

Scope: we ship to the 50 U.S. states, DC, and U.S. territories; we do not ship internationally.
Carrier/service: USPS Priority Mail® with tracking (estimated 1–3 business days; territories/APO/FPO/DPO and remote areas may take longer).
Processing: in-stock items ship the next business day after payment verification; for custom or out-of-stock items we will coordinate production and ship dates with you.
Risk of loss; signature/insurance: risk of loss may pass once the package is tendered to the carrier. We recommend signature required and shipping insurance for high-value orders.

8) Returns, Exchange & Repairs

Custom/made-to-order items may be final sale unless defective, as stated in the Returns Policy.

9) Permitted Use; Resale

The Site and its content are for lawful, personal use. We may limit or cancel orders we believe are placed by resellers.

10) Intellectual Property

All Site content (text, images, logos, designs, photos, descriptions, code) is owned by MOIRA or used under license and protected by copyright and trademark laws. No license is granted. You may not copy, reproduce, modify, or distribute without written consent.

11) User Content (Reviews, Comments)

If you submit reviews or ideas, you grant MOIRA a non-exclusive, worldwide, royalty-free license to use and display such content for promotional purposes, subject to our Privacy Policy. Do not submit unlawful, defamatory, misleading, or infringing content.

12) Materials, Care & Product Safety

Our products may include sterling silver and other materials. Patina and normal wear are expected. Please follow care instructions. We are not responsible for individual allergic reactions. Keep items away from small children and pets.

13) Warranties; Disclaimers

Except where prohibited by law, the products and the Site are provided “as is” and “as available”, without warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant the Site will be error-free or uninterrupted.

14) Limitation of Liability

To the maximum extent permitted by law, MOIRA will not be liable for indirect, incidental, special, punitive, or consequential damages (including loss of data, revenue, or profits). Our total liability for any claim relating to a product or the Site is limited to the amount you paid for that product or, if not applicable, USD $100. Nothing herein limits non-waivable consumer rights.

15) indemnification

You agree to indemnify and hold harmless MOIRA and its personnel from claims arising out of your use of the Site, breach of these Terms, or violation of third-party rights.

16) Force Majeure

We are not responsible for delays or failures caused by events beyond our reasonable control (severe weather, disasters, strikes, outages, pandemics, government actions, carrier or vendor failures).

17) Promotions, Coupons & Gift Cards

Promotions are subject to specific terms posted with each offer and may change or end without notice. Unless stated, coupons are not combinable. Gift cards (if offered) are non-refundable except as required by law.

18) Third-Party Links

The Site may link to third-party sites. We do not control or endorse their content or practices and are not responsible for them.

19) Electronic Communications

By using the Site or contacting us, you consent to receive electronic communications related to your orders or customer service. You may unsubscribe from marketing at any time.

20) Changes to These Terms

We may update these Terms at any time. The “Last updated” date shows when they take effect. Continued use of the Site after changes constitutes acceptance.

21) Dispute Resolution; Binding Individual Arbitration

Arbitration Agreement. Except as provided below, you and MOIRA agree that any dispute, claim, or controversy arising out of or relating to the Site, any purchase, or these Terms will be resolved by binding individual arbitration, not in court before a judge or jury. This agreement is governed by the Federal Arbitration Act (FAA) and administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules then in effect. Any hearing (if any) may be held by video conference or in the consumer’s county of residence; if AAA is unavailable, the parties may select a comparable administrator.

Class Action Waiver. You and MOIRA agree that each may bring claims only in an individual capacity, not as a plaintiff or class member in any class or representative action.

Fees & Costs. The consumer will pay only the filing fee required by the AAA rules; MOIRA will pay all remaining administrative and arbitrator fees for the proceeding.

Small Claims. Either party may bring a dispute in small claims court with proper jurisdiction in Virginia or in the consumer’s state/territory if the claim qualifies.

Injunctive Relief. Either party may seek limited injunctive relief in court to protect intellectual property rights or prevent unauthorized use of the Site, while the merits proceed in arbitration.

Opt-Out. If you do not wish to arbitrate, you may opt out by emailing Info@moirasilverthreads.com with subject “Arbitration Opt-Out,” stating your name and the date of your first purchase, within 30 days of that first purchase.

Severability & Survival. If any part of this clause is found invalid or unenforceable, the remainder will remain in effect; this clause survives termination of the Terms.

Governing Law & Seat. These Terms are governed by the laws of the Commonwealth of Virginia, USA (without regard to conflicts of law). The seat of arbitration is Virginia, without prejudice to the consumer appearing remotely or in their county under AAA rules.

22) General Provisions

Assignment. You may not assign your rights/obligations under these Terms without our consent.
No Waiver. Failure to enforce a provision is not a waiver.
Entire Agreement. These Terms, together with the linked policies, are the entire agreement between you and MOIRA.
